Welcome to ProspectFlow. These Terms of Service ("Terms") govern your access to and use of the ProspectFlow website, software, Chrome extension, and related services (collectively, the "Service"), operated by Ruben Plata ("ProspectFlow," "we," "us," or "our").
By purchasing, accessing, or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
1. Description of Service
ProspectFlow is a software-as-a-service (SaaS) customer relationship management (CRM) and lead-organization tool designed for individuals and small businesses conducting organic marketing and prospecting activities on Facebook. The Service includes a web-based dashboard and a Chrome browser extension.
ProspectFlow is a read-only tool. It captures and organizes information you already have access to on Facebook (such as comments, messages, and profile data visible to you). ProspectFlow does not post content, send messages, or take any automated action on your behalf on Facebook or any other platform.
2. Eligibility
You must be at least 18 years old and legally able to enter into a binding contract to use the Service. By using the Service, you represent that you meet these requirements.
3. Account Registration
To use the Service, you must purchase access and complete account setup via the invitation link sent to your email. You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account.
4. Subscription, Fees, and Payment
- ProspectFlow is offered on a subscription basis (monthly) or as a one-time lifetime access purchase, as described at the time of purchase.
- All fees are billed in advance. Our refund policy is as follows:
- Monthly plan: Your first payment is refundable if requested within 7 days of purchase. After 7 days, you may cancel at any time, which will stop future billing; no refunds are issued for partial or already-completed billing periods.
- Lifetime access: Refundable within 7 days of purchase if you are not satisfied. After 7 days, all lifetime purchases are final.
- We reserve the right to change pricing for future billing cycles with reasonable notice.
- Failure to pay may result in suspension or termination of your access to the Service.
5. Acceptable Use
You agree not to use the Service to:
- Violate any applicable law or regulation, including Facebook's own Terms of Service and Community Standards
- Engage in spam, harassment, or deceptive marketing practices
- Attempt to reverse-engineer, resell, or redistribute the Service without authorization
- Use the Service for any unlawful, fraudulent, or harmful purpose
You are solely responsible for how you use any data or leads captured through the Service, including compliance with applicable privacy and marketing laws (such as CAN-SPAM or similar regulations in your jurisdiction).
6. Facebook Platform Compliance
ProspectFlow is an independent tool and is not endorsed by, affiliated with, or sponsored by Meta Platforms, Inc. or Facebook. Your use of Facebook remains subject to Facebook's own Terms of Service, and you are responsible for ensuring your use of ProspectFlow complies with those terms.
7. Intellectual Property
All content, software, branding, and materials associated with ProspectFlow are the property of Ruben Plata / ProspectFlow and are protected by applicable intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the Service for your own business purposes only.
8. Third-Party Services
The Service may integrate with or rely on third-party platforms (including Facebook, Stripe, Supabase, and Systeme.io). We are not responsible for the availability, performance, or policies of these third-party services.
9. Disclaimer of Warranties
The Service is provided "as is" and "as available," without warranties of any kind, express or implied. We do not guarantee that the Service will be uninterrupted, error-free, or that it will result in any specific business outcome (such as increased sales or leads).
10. Limitation of Liability
To the fullest extent permitted by law, ProspectFlow and its owner shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Service, including lost profits or lost data.
11. Termination
We reserve the right to suspend or terminate your access to the Service at any time for violation of these Terms. You may cancel your subscription at any time; cancellation will take effect at the end of your current billing period.
12. Changes to These Terms
We may update these Terms from time to time. Continued use of the Service after changes are posted constitutes your acceptance of the updated Terms.
13. Governing Law
These Terms shall be governed by the laws of the Commonwealth of Pennsylvania, without regard to its conflict of law principles.
